Welcome to Zinkly (accessible via Zinkly.org), a social platform and community space dedicated to freedom of expression, creativity, and authentic connection.

By accessing or using Zinkly, you acknowledge that you do not acquire any ownership rights in the platform or its proprietary content. You are granted a limited, revocable, non-transferable license to access the platform in accordance with these Terms.

4. Account Security and Responsibilities

Accuracy: You agree to provide accurate, current, and complete information during registration and to keep your account details updated.
Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Restrictions: Your account is personal to you. It is strictly non-transferable and may not be sold, shared, or assigned to any third party.
Compromise: You must immediately notify Zinkly support if you suspect or become aware of any unauthorized use of your account.

5. Community Principles and Prohibited Conduct

Zinkly fosters open dialogue, but requires all users to act responsibly. You agree that you will not post, upload, or transmit any content, or take any action, that:

Features or promotes illegal drugs, weapons, explicit sexual material, or unlawful acts.
Constitutes hate speech, racism, harassment, threats, or defamation.
Infringes upon the intellectual property, privacy, or publicity rights of any third party.
Utilizes bots, scripts, scrapers, or other automated tools to manipulate engagement, mine data, or access the platform.
Attempts to disrupt, degrade, or compromise the security, performance, or integrity of Zinkly’s servers or networks.

6. Intellectual Property Rights

Zinkly IP: All rights, title, and interest in Zinkly’s design, code, logos, trademarks, and platform features belong exclusively to Zinkly.org.
User Content License: You retain ownership of the original content you create and post on Zinkly. However, by submitting content to the platform, you grant Zinkly a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, display, reproduce, modify, and distribute your content solely for the purposes of operating, developing, and promoting the platform.

7. Payments, Marketplace, and Refunds

A. Marketplace Disclaimer

Zinkly provides a public marketplace platform facilitating peer-to-peer (user-to-user) transactions.

Important: Zinkly.org is not a party to any transaction between marketplace buyers and sellers. Administrators and moderators do not act as escrows and are not liable for user disputes, scams, or financial losses. Users engage in marketplace transactions entirely at their own risk.

B. Direct Platform Payments & Refunds

If you purchase paid features, addons, or subscriptions directly from Zinkly, the following terms apply:

Processing Time: Approved refunds will be processed and returned to the original payment method within 5 to 35 business days (depending on banking institutions).
Eligibility: Refunds will not be issued once a digital license, script, or addon has been accessed or used, except in cases where a documented system failure or critical bug directly caused by Zinkly renders the service unusable.

8. Content Moderation and Enforcement

Zinkly reserves the right, but does not assume the obligation, to monitor and review user-generated content. We reserve the absolute right to:

Remove, edit, or restrict the visibility of any content that violates these Terms or our Community Guidelines.
Suspend, restrict, or permanently terminate accounts for repeated or severe violations.
Modify our moderation protocols and visibility algorithms at any time without prior notice.

9. Platform Restrictions

You are strictly prohibited from:

Reverse-engineering, decompiling, or copying Zinkly’s underlying source code or architecture.
Using Zinkly for unauthorized commercial exploitation or spam distribution.
Circumventing or attempting to bypass any security measures or access controls.
Framing or mirroring portions of Zinkly without explicit written permission.

10. Disclaimers and Limitation of Liability

"As Is" Basis: Zinkly is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the uninterrupted availability, security, or error-free operation of the platform.
Third-Party Content: Zinkly is not liable for content posted by users, interactions between users, or third-party links hosted on the platform.
Limitation of Liability: To the maximum extent permitted by applicable law, Zinkly.org, its affiliates, and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of or inability to use the platform.

11. Termination

By Zinkly: We may suspend or terminate your access to the platform at any time, with or without cause, including for violations of these Terms.
By You: You may close your account and terminate this agreement at any time by navigating to your account settings or contacting support.

12. Governing Law and Jurisdiction

These Terms and any disputes arising out of them shall be governed by and construed in accordance with the laws of Greece, without regard to its conflict of law principles. Any legal action or proceeding relating to Zinkly shall be brought exclusively in the courts located in Greece.
